Terms of Service:

New ICANN Requirements:
Recently the Internet Corporation for Assigned Names and Numbers ("ICANN") rules changed to require all registrars post notices of certain terms, conditions, rights and responsibilities involved with registering your domain name(s).

Registering Domain Names:
Annexa.net provides a registration service to you in conjunction with a hosting plan for a fee of $15.00 / Yr. We provide this service as an affiliate of Aplus an ICANN accredited registrar. You own your domain and are listed as the Registrant with Aplus. Annexa.net is usually listed as Administrative, Billing & Technical Contacts. Annexa will contact you by email for payment when your domain name renewal is pending.

By registering or renewing your domain name registration you agree to the terms and conditions outlined in various ICANN documentation. You also have certain rights and responsibilities in connection with your domain registration. Acceptable Use:
Annexa.net is pleased to offer service to commercial, not-for-profit, personal and game related websites. Annexa.net is not interested in websites that provoke controversy or infringe on anyone's rights.

You agree that your web site and email accounts will not be used for any controversial, illegal or unethical purpose. Acceptable use is generally limited to the legitimate interests of yourself, business or organization.

Unacceptable uses:

Annexa.net reserves the right to refuse service to any individual, business or organization at our sole discretion. If you have a question about your business plan, or our Acceptable Use Policy, please feel free to contact us. Annexa will not host businesses or organizations that involve or link to:

	Sexually explicit materials (no exceptions)
	Copyrighted materials (unless you own the rights to publish same)
	Programs (warez, cracks etc.)
	Infringe on the rights of others (hate, discrimination etc.)
	Send unsolicited or anonymous email (Spam) to others
	Operate / install software for the purpose of attacking other internet systems
	Install / operate un-secure software such as IRC Chat, robots (Bots) etc
	Attempt to register and operate a website under false pretenses
	Make payment with a third party or stolen credit card
	Websites that may be attacked by rouge individuals or opposing organizations

Any of these, or similar, activities will be cause for immediate termination of our agreement and suspension of your website's operation. You agree that any payments made prior to such a breach are nonrefundable.

Payment:

You may choose monthly billing, or you may choose to pay for 6 or 12 months in advance. Forms are provided for direct purchase by credit card in either case. Failure of your monthly credit card payment may result in suspension of your website's operation. Additional fees may apply to reinstate the operation of your website following a suspension.

Payment by check or money order may also be provided for 6 or 12 month in advance. Acceptance of pre-payment does not relieve you from adherence to our terms of service. Annexa reserves the right to suspend or remove accounts in violation of our terms of service without regard to any pre-payment.

Your hosting account is subject to the limits embodied in the appropriate plan description section. Excess bandwidth (data transfer) is charged at the rate applicable at the time, currently $5.00 per GB per month. Use of excess disk space may require an upgrade to the next highest level of hosting.

Accuracy of Information:

You, and not Annexa, are solely responsible for the accuracy and appropriateness of the information your web pages present to the public on the Internet. Annexa is in no way liable for the accuracy and appropriateness of information you include in your web pages or any resulting damages of any kind.

Availability (Up-Time):

Annexa is proud of our record of 99.5% reliability and uptime. Annexa makes every effort to ensure the availability of your web pages and information. Our servers have strong connections to the internet and reliable power availability.

However, Annexa is in no way liable for damages of any kind, including loss of use or profit, as a result of your information or email being unavailable for any reason whatsoever. We provide a mechanism for making your own backups and encourage you to take advantage of this mechanism.

Legal Liability:

Annexa does not warrant, guarantee or make any representation whatsoever regarding the use of, or the results of the use of, our services. You assume the entire risk as to the results and performance of the information you host with Annexa, including any legal liability that may arise out of the publication of such information on the internet.

Annexa will respond to reports of abuse originating from our hosted domains and will comply with requests from legal authorities. Should the information you publish prove to be an infringement of any legal right, you assume the entire cost of correcting such information and you agree to pay for the defense of any legal claim or action brought against you and or Annexa as a result.

Annexa makes no representation whatsoever as to your use of the Internet generally and the reliability, fitness for use or good character of any information you may encounter on the Internet. Annexa is not responsible for, and will not respond to, reports of abuse, including Spam complaints, originating from outside sources.

Remedy of Dispute:

Your sole and exclusive remedy in any dispute with Annexa, or our Terms Of Service, is a refund of your current month's hosting fee. Fees paid to third parties for services are non-refundable.

Authority:

By submitting an order form, or otherwise purchasing our services, you affirm that you have the authority and are of legal age to enter into a binding contract. You also agree to the terms and conditions expressed above. Annexa reserves the right to change our Terms Of Service and by continuing to use our services you agree to be bound by such changes.
